The proposed legal marijuana bill in Pennsylvania could bring significant changes for its residents. The bipartisan bill aims to legalize marijuana for adult use, ban marketing to children, create a state regulatory board and a social equity program, and impose an 8% sales tax in addition to a 5% excise tax on dispensary sales.

Currently, Pennsylvania has a robust medical marijuana program, with about 4% of the adult population participating. The commonwealth legalized medical marijuana in 2016, and dispensaries began selling to patients who qualified in 2018. Sales have gone up steadily since then, exceeding $1.3 billion in 2021. The Medical Marijuana Act has been amended over the years, expanding the types of medical conditions that qualify.

The proposed bill, known as H. B. 2050, would make it legal for anyone 21 and older to purchase and consume recreational marijuana in Pennsylvania. This bill mirrors a State Senate bill, Senate Bill 846, and aims to replace the unregulated illicit market with a taxed and regulated system with licensed growers, processors, and retailers. It also includes a robust clean slate program, including release from incarceration.

Generates money for the state

According to the Pennsylvania Independent Fiscal Office, Recreational marijuana legalization for adults in Pennsylvania could generate $400 million to $1 billion in tax revenue for the state. This revenue could fund various state programs and initiatives, providing a significant boost to the state's economy.

Moreover, the legalization could also prevent Pennsylvania residents from traveling to neighboring states that have legalized adult-use marijuana, which would keep more money within the state and potentially boost local businesses.

This bill not passed yet

However, it's important to note that the bill is still under consideration. Such a bill's implications depend on the legislation's final details and how it is implemented. As such, Pennsylvania residents should stay informed about the progress of this bill and consider how it might impact them personally.

This bill has its critics, who voice concerns about health risks, public safety and related issues. Still, the proposed legal marijuana bill could bring significant changes to Pennsylvania, from potential economic benefits to changes in the legal status of marijuana use. However, the final impact will depend on the specifics of the final legislation.

Truckers are responsible for operating heavy vehicles that carry massive amounts of cargo all across the country. In an effort to keep the roadways safe, the Federal Motor Carrier Safety Administration (FMCSA) uses a Compliance, Safety, Accountability (CSA) scoring method to determine how safe motor carriers and commercial truckers are.

The score given to a particular driver or entity is the result of assessing seven specific areas of concern that are critical for commercial trucking safety. A score ranges from 0, which is the safest score to 100, which is the least safe score. Each violation of a point in the seven critical safety areas can add 1 to 10 points, so a score of 100 comes with at least 10 violations.

What are the seven safety points?

The seven safety areas are known as the Behavior Analysis and Safety Improvement Categories (BASIC). These include:

Unsafe driving: Reckless driving and speeding

Crash indicator: History of crashes

Hours-of-Service compliance: Violations of HOS regulations

Vehicle maintenance: Braking or light issues, failing to take care of required repairs

Controlled substances/alcohol: Possession or use

Hazardous materials compliance: Improper placards, leaking or improper containers

Driver fitness: Lack of medical documentation, invalid license

The severity of the issue determines the number of points. For example, an impaired driver automatically receives 10 points, a seat belt violation is 7 points and loose cargo is 1 to 7 points.

Once the base number of points is determined, the number is multiplied by one to three, depending on how recently the infraction occurred.

3x: Carriers 1 to 6 months ago, drivers 1 to 12 months ago

2x: Carriers 7 to 12 months ago, drivers 13 to 24 months ago

1x: Carriers 13 to 24 months ago, drivers 25 to 36 months ago

Once the required time from the violation elapses, which is 24 months for carriers or 36 months for drivers, the points fall off the record.

How do traffic violations impact CSA?

Traffic violations fall under the unsafe driving BASIC. This means that each one can lead to points. Commercial drivers have the option of fighting tickets they receive, which may help to keep their CSA score as low as possible. In some cases, the violation they’re charged with might be able to be reduced to something that won’t lead to as many points. This could help them to avoid a higher CSA score so they aren’t considered highly unsafe and incur issues with insurability and employability.

Drivers who are concerned about fighting tickets in order to keep their score low may benefit from seeking legal guidance to learn more about their rights and options.

Most people find that it's an investment in their future where they are free of an unhappy or dysfunctional marriage. But it can get expensive. Beyond having to give up much of your marital property, there are direct expenses like attorney's fees.

In many types of litigation -- which a divorce essentially is -- the parties can ask the judge or jury to order the other side to pay their legal fees as part of the verdict. So you might be wondering if you can do the same thing in your divorce. Is it possible to get your ex to pay your attorney's fees in Pennsylvania?

The times you can ask for it

It is, but it's not easy. Most divorcing people have to pay their legal fees themselves. But family court judges do have the discretion to order one spouse to pay the other's fees upon request in certain circumstances. Specifically, you can request it when you relied on your spouse for income during the marriage and you cannot afford to pay for a lawyer. Another scenario is when your spouse is recklessly (or purposely) driving up your fees with frivolous motions, dragging out settlement talks or otherwise abusing the system.

It can be challenging to get the court to have your ex pay your attorney's fees. But most divorce lawyers charge reasonable fees given the level of knowledge and experience they bring to your case, as well as the hours they spend examining evidence, devising strategy with you and negotiating on your behalf.

Almost everyone who gets arrested in Luzerne County wants to get out of jail as soon as possible. But you may have to post bail before you can go home and start searching for a Hazelton bail attorney.

Essentially, bail is a financial promise that you, as the defendant, will attend all pretrial hearings and your trial itself (if necessary) in exchange for being out of custody. It is also an acknowledgment that as a suspect, you have not been convicted of a crime and are presumed innocent until proven guilty beyond a reasonable doubt.

How bail is set after an arrest

After being arrested, a suspect will go before a magisterial district judge (MDJ), who will determine whether to set bail, release the suspect on their own recognizance or order them held in jail until their case is resolved. Both the prosecutor and defendant (or their defense attorney) will make their case for whether bail should be set and for what amount. Factors that the MDJ will consider include:

The severity of the alleged offense

The defendant's employment and financial status

The defendant's ties to the community

The defendant's criminal record, if they have one

Whether they have a history of flight after being assigned bail in prior cases

Pennsylvania law gives the MDJ five options:

Release on recognizance, which means the defendant is released after signing a document promising they will show up to court.

Release on nonmonetary conditions, which imposes further restrictions on the defendant, such as where they can live and with whom they can associate while their case is pending.

Release on unsecured bail bond. The defendant can put up the amount of cash ordered by the MDJ, which they agree they will forfeit if they violate the MDJ's terms or fail to appear.

Release on nominal bail. The defendant pays a small amount in bail and signs an agreement with a surety.

Release on monetary conditions, which requires the defendant to pay a large cash bail or put up a property bond or secured bond.

In addition, the defendant can be denied bail in some cases, such as when they are charged with a capital offense or the MDJ believes keeping them in jail is the only way of guaranteeing they will appear in court.

Most people cannot afford to post a high bail on their own, which is where bail bondsmen come in. A bail bondsman posts bail for the defendant, who pays the bail bondsman a small percentage of at least ten percent. Keep in mind that the higher the bail is, the more a bail bondsman earns.

Cash bail is controversial because it seems to favor defendants with significant financial resources over those struggling with poverty. But it is still the policy in Pennsylvania and most other states.

Help fighting for reasonable bail

You are entitled to an attorney's help at every stage of the criminal law process, including at the bail phase. Your lawyer can speak with the police and prosecutor about reaching a reasonable bail amount or even possibly letting you free on recognizance. They can also represent you at the hearing and explain why the MDJ should not set an excessive bail.

You may be charged with drunk driving if you attempt to operate a vehicle while impaired in Pennsylvania. This may significantly impact your life regardless of what you do for a living. However, if you are an airline pilot, a DUI conviction may stall your career or even end it entirely.

You must report the DUI

You must file a report with the federal aviation administration (FAA) within 60 days of being charged with DUI. If you fail to do so, your pilot license may be suspended or revoked. In addition, your license may be suspended or revoked if this is your second drunk driving incident within the last three years.

You may face other penalties

Losing your pilot license may only be a part of your overall punishment if convicted of drunk or impaired driving. You may also be sentenced to jail or prison time, pay a fine or lose your driving privileges for several months or years. The exact structure of your sentence will depend on the specific facts of your case and your criminal history. For example, you may face harsher penalties if you are charged with a felony or if you have been previously convicted of DUI.

Other issues to consider

If you lose your driver's license, you may be unable to drive to work, making it difficult to find or retain employment. After accounting for legal fees and other costs related to your DUI case, you may also find it difficult to afford a home or apartment. Other collateral penalties may also apply after being released from jail or prison, such as the need to install an ignition interlock device (IID) on your vehicle.

A DUI charge may cause a significant interruption to your personal or professional life. However, it may be possible to have the charge reduced or dismissed by casting doubt on evidence introduced before or during the trial. Evidence may include the results of a field sobriety test or chemical tests performed during a traffic stop.
When going through a divorce in Pennsylvania, everything you own or are a part of will be reviewed. This means that, depending on the circumstances of your marriage, a portion of your business' assets, profits and debts may become part of the settlement. This new change could have a direct impact on your day-to-day operations and may require some financial adjustments.

Co-owning the business

If the family law court awards your spouse a share of the business, you may need to reorganize the ownership structure. This can have both positive and negative effects. If you can work together effectively with your ex co-ownership may work. If not, the situation could quickly get difficult and messy.

The financial impact

Not only will you have a new partner in managing your business, but you may also need to divide up profits and debts with them as part of the settlement. This can lead to major cuts in income or an increase in expenses for you, especially if you are taking on additional debt from your ex.

Company's reputation

A business's value doesn't only lie in its assets and finances; most survive because of the brand (reputation) the owners have built for years. If you are the face of your company, a divorce scandal can have a ripple effect and cause distrust among customers, vendors and investors.

Your mental health and changes to your ability to work

Divorce is stressful, confusing and painful, even in the best of circumstances. The added stress of dealing with a business can make it even worse. In addition, you may need to take more personal time away from the office while you attend court hearings and lawyer meetings. All this will undoubtedly affect your ability to stay focused and productive at work, which can further hurt your business.

The best way to make sure your divorce doesn't harm your business is to prepare yourself beforehand. Consider researching the laws in Pennsylvania about separation that are unique to your case and find amicable ways to protect your interests. For example, if you don't want matters of your divorce to become a public affair, you can explore avenues such as mediation or arbitration to settle your issues. Additionally, you can buy your spouse's shares in the business if you want to keep it all to yourself.

The startling truth is that you have been pulled over by law enforcement after an enjoyable night out with friends. The pleasure of that gathering seems far in the past now that a drunk driving charge is possible for you.

A few thoughts stream through your mind. What do you do? What should you not do? The main thing is not to panic but understand that you are in a delicate situation. A DUI conviction can complicate your life. Your initial contact with the arresting officer may have a significant impact on the outcome.

Failing to listen, fleeing an officer

When stopped for suspected DUI, please make sure to avoid the following:

Talking too much: You do not have to answer the officer’s questions other than to provide your name, driver’s license, vehicle registration and insurance information. The arresting officer will try to get you to keep talking in hopes that you will make incriminating statements.

The divorce process can be scary. Your financial stability can certainly take a hit, but if you’re like most parents, then your primary concern may be how your divorce will affect your relationship and time with your children. This might be especially true if you’re a father.

There’s a perception out there that the law favors mothers when it comes to child custody arrangements, which means that fathers are behind the eight ball when it comes to securing primary physical custody or even lenient visitation.

Fortunately, this isn’t true. Pennsylvania’s child custody laws are gender neutral, meaning that they don’t favor one parent over the other. Instead, the statutes focus on finding some sort of arrangement that is best for your children.

What is taken into consideration when the court issues a custody order

When you’re in the midst of a custody dispute, it can be easy to get lost in all of the back-and-forth that you’re having with your spouse or former spouse. As such, it might be difficult to step back and tailor your arguments to fit the best interests determination that the court is tasked with making. The good news is that you can turn to the law for guidance.

Under Pennsylvania law, the court is allowed to consider a number of factors when making a custody determination. Those factors include:

The parental responsibilities that each parent carried during the marriage

Each parent’s ability to provide a stable and loving home

The child’s bond with each parent

Any history of drug or alcohol abuse possessed by each parent

Each parent’s mental health

The physical health of each parent

Each parent’s ability and willingness to encourage a positive relationship with the other parent

The child’s preference, depending on his or her age

The child’s needs, including those pertaining to education and medical care

Any history of domestic violence

Although that may seem like a lot, the fact is that the statute allows the court to take any other facts that it deems relevant into consideration. Therefore, as you prepare your child custody case, you need to take a holistic look at the facts at hand not just to prepare your arguments, but also to anticipate the other side’s strategy so that you can effectively counter it.

How do you build your custody case?

There are a lot of things that you can do right now to build your custody case. You can obtain any records that may be indicative that the other parent poses a threat to your child, such as police reports or inappropriate text and email communications, but you can also gather evidence that you’re an appropriate parent who has a strong bond with his child. Think about witnesses who can attest to your parental abilities, and consider whether seeking a child custody evaluation is proper under the circumstances. And always craft your arguments with the child’s best interests in mind.

Do you need an attorney’s help?

With so much to take into consideration, it’s easy to get tangled up and struggle to make targeted arguments that seek the outcome that you think is right for your child. But that’s where an experienced family law attorney may be able to assist you. So, if you think that you could benefit from having a legal advocate on your side who can help you argue for your child’s best interests, then now may be the time to seek out that help.

That is understandable given everything that is at stake. But even if you reach a settlement with your spouse that you think is in your best interests, circumstances can change, leaving you feeling cheated.

This is often the case when spousal support is in play. As incomes change and life events occur, a modification of spousal support may be warranted. So, if you think that you need to either increase or decrease an existing alimony award, you may want to consider whether any of the circumstances identified below exist. Remember, though, that you are only going to obtain a modification if you file a motion with the court and prove that your request is fair.

When a spousal support obligation can be decreased

If you owe spousal support and are hoping to decrease your obligation, you will need to look for evidence to indicate either that your former spouse is no longer in need of assistance or that you are no longer able to meet the support obligation. Therefore, any of the following circumstances may justify a motion to modify spousal support:

You lose your job

Your income is drastically increased

You suffer from the onset of a sudden injury or illness

Your former spouse obtained a job

Your former spouse obtained a higher education degree

Your former spouse starts cohabitating with someone else

Your former spouse remarries

Your former spouse’s income increases significantly

Some of these circumstances are easier to prove than others. For example, you are going to know if a medical condition affects your ability to fulfill a support obligation, and it is relatively simple to figure out if your former spouse remarries.

But some of these situations, like cohabitation, can be more challenging. Here, you will need to be diligent in assessing social media, where your former spouse is living, and the relationship between your former spouse and anyone with whom they live.

When a spousal support obligation can be increased

If you receive spousal support and feel like you are deserving of more, you still need to convince a judge why that is the case. Here are some situations that may warrant an increase in an existing support obligation:

Your former spouse gets a promotion or job increase

You suddenly lose your job or face a wage decrease

You are unexpectedly hit with larger expenses than you expected, such as if you suddenly need extensive medical treatment

The expenses that your former spouse was facing at the time of the initial order have decreased significantly

Just like those who are seeking a decrease in spousal support, you are going to need evidence to support your request. Subpoenaing records from your former spouse can go a long way here, but you will also want to make sure that you are appropriately documenting your living situation and your expenses.

Do not leave your spousal support matters to chance

If you were part of a high-asset divorce, the spousal support that is being paid as part of your divorce is probably significant. Therefore, you owe it to yourself to take legal action if you need to seek a modification.

We know that the thought of entering another contentious dispute with your ex-spouse is not all that appealing. But you deserve to be as financially sound as possible. This means fighting to ensure fairness in your spousal support matter.

The process is not always as easy as it may seem, either, even if the facts seem to fall in your favor. Therefore, if you want to secure your position as fully as possible, you might want to think about having a skilled legal advocate on your side to help you fight for the fair outcome that you deserve.

One answer is the Fourth Amendment to the U.S. Constitution. The Fourth Amendment provides some of the most important criminal law protections the American people have, including the right to be free from "unreasonable searches and seizures."

The Fourth Amendment plays an important role in many criminal defense cases, and can often mean the difference between a conviction and an acquittal.

Probable cause

Over the past 200 years since the amendment was ratified, courts have argued many times about what it means, exactly, and have had to decide what counts as a "search," what counts as a "seizure," and, most controversial of all, what counts as "unreasonable." At times, the courts have seemed to expand the power of the Fourth Amendment, and at other times they have seemed to rein it in.

Today, courts generally agree that the protection against unreasonable search and seizure means that before police can arrest a person or search their property, they must get a warrant supported by probable cause. Essentially, this means they must convince a court that it is more likely than not that they have evidence of a crime committed by the person, or that they will find the evidence in a search.

However, there are many exceptions to the warrant requirement.

Warrant exceptions

One exception occurs in emergency situations. Another occurs when the police see evidence of a crime in plain view. For instance, if a police officer pulls over a driver and sees illegal drugs sitting on the passenger seat of their car, the police do not need a warrant to search the car for evidence of drugs.

Things get trickier when evidence is not in plain view. The Fourth Amendment says the people should be free in their "persons, houses, papers and effects" from unreasonable searches and seizures. Over the years, courts have determined this means that warrants are more important in places where the person has a "reasonable expectation of privacy."

A person who carries evidence of a crime freely in public has no reasonable expectations of privacy, and so the police are not violating the Fourth Amendment if they stop the person and search them. However, it's reasonable for people to expect privacy in their homes. If the police are going to enter someone's home to search for evidence of a crime, they had better have a good reason. Better yet, they should have a warrant supported by probable cause.

Criminal defense

If the police violated a defendant's Fourth Amendment rights in a search, the prosecution cannot use evidence the police found in that search. Without this evidence, the prosecution has a much harder time proving its case, and the defendant may beat the charges.
